A recipient is understood to be the natural or legal person, public authority, agency or other body to which personal data are disclosed, whether or not it is a third party.

METRICOOL SOFTWARE is part of the team.blue Group and is a joint controller with team.blue N.V. The team.blue Group, led by team.blue N.V. and made up of several brands and subsidiaries, may improve coordination and resource allocation by sharing data internally. This allows more efficient collaboration on improving products, campaigns and customer service. Customer data, such as contact, user, billing and purchase information, may be shared with team.blue N.V. for marketing statistics, internal administration and reporting purposes, but only to the extent necessary for the intended use and with appropriate protective measures in place to prevent unauthorised access or disclosure.

Your data will not be disclosed to any third party outside METRICOOL SOFTWARE unless there is an appropriate applicable legal basis.

Data processors: There are data processors, understood as entities that process personal data for which METRICOOL SOFTWARE is responsible, following its instructions, as service providers necessary for the provision of the service requested by the Data Subject, with whom METRICOOL SOFTWARE has signed a data processing agreement in accordance with the applicable data protection regulations. As a Data Subject, you are entitled to exercise the following rights recognised by data protection regulations, in accordance with their provisions:

– Right to withdraw at any time the consent given for the processing of such data, where the legal basis for the processing is that consent.

In that case, METRICOOL SOFTWARE will stop processing the data, except for compelling legitimate grounds or the exercise or defence of possible claims.

– In certain circumstances and on grounds relating to your particular situation as Data Subject, you may exercise the right to data PORTABILITY. This right is complementary to the right of access, as it allows you to obtain the data you have provided to METRICOOL SOFTWARE in a structured, commonly used and machine-readable format, and to have them transmitted directly to another entity at the request of the Data Subject.

You may exercise these rights by writing to [email protected].

In addition, if you consider that any of your data protection rights have been infringed, you are entitled to lodge a complaint with the Spanish Data Protection Agency (AEPD), located at C/ Jorge Juan, 6, 28001-Madrid https://www.aepd.es/ or through the AEPD’s electronic office: https://sedeagpd.gob.es/sede-electronica-web/.

(a) Via Google Security Settings: you can revoke Metricool’s access to your YouTube account directly from Google’s security settings page at: https://myaccount.google.com/connections.

Upon revocation through this mechanism, METRICOOL SOFTWARE will delete all Authorised Data associated with your YouTube account within 30 calendar days of the revocation.

(b) Via Metricool: you can also request the deletion of your stored YouTube data by contacting METRICOOL SOFTWARE at [email protected] or by disconnecting your YouTube account from within Metricool. Upon such a request, METRICOOL SOFTWARE will delete the relevant data as soon as possible and within a maximum of 7 calendar days. Please note that deleting the data stored by METRICOOL SOFTWARE does not delete the data stored by YouTube. To delete data on YouTube directly, you must use the YouTube application or another authorised client that supports the deletion of such data.

8. Security

In order to safeguard the security of the personal data of Data Subjects, METRICOOL SOFTWARE informs you that it has adopted all the technical and organisational measures necessary to guarantee the security of the personal data provided.

All of this is intended to prevent their alteration, loss and/or unauthorised processing or access, as required by the regulations, although absolute security does not exist.

9. Updating of personal data

In order to keep their personal data up to date, the Data Subject may modify or rectify them through their Customer account in Metricool or by contacting METRICOOL SOFTWARE.

10. Confidentiality

You are also informed that the data of Data Subjects will be processed with the utmost care and confidentiality by all personnel involved in any of the stages of the processing.

11. Cookies

At present, METRICOOL SOFTWARE, in the Metricool application for iOS or Android, does not use data storage and retrieval devices on users’ devices other than those of a technical nature, for the sole purpose of transmitting a communication over an electronic communications network or, to the extent strictly necessary, for the provision of the Metricool service expressly requested by the Data Subject.

Should METRICOOL SOFTWARE use such data storage and retrieval devices in the future, clear and complete information about them will be provided and the Data Subject’s consent will be obtained through the appropriate settings of the Metricool application.

METRICOOL SOFTWARE, in the web version of Metricool, uses cookies in accordance with the provisions of the Cookies Policy.

12. Processing of data as Data Processor

If you have registered as a Customer in Metricool to manage your own Brands or those of third parties, METRICOOL SOFTWARE is, in accordance with data protection regulations, considered a Data Processor, since it may have access to personal data on your behalf and following your instructions. In that case, you will be the Data Controller of such data, since you decide how and for what purpose the data of the Brand you manage are processed, by contracting Metricool’s services.

When you register a Brand in Metricool and associate social media accounts with that Brand, you must accept the permissions that each social network grants to METRICOOL SOFTWARE so that it can provide the contracted services.

Once you accept the permissions requested by each social network, each of them will allow METRICOOL SOFTWARE to access the management of the account on the corresponding social network, with access to the creation and management of content and/or posts, comments, direct messages and statistics, as well as the management of ads and the statistical data of such ads, for the sole purpose of providing the service contracted by you as Customer: performance metrics, social media planning, automatic performance reports and the possibility of creating advertising campaigns from the platform itself, among other features.

In addition, depending on the features you activate and use, METRICOOL SOFTWARE may process on your behalf personal data of the following categories of data subjects:

– Customers and/or users of the Customer or of the managed Brand (including, where applicable, End Users): name and email address.

– Third parties authorised by you to access your Metricool account (Team Members): name and email address.

– Contacts in the social media accounts of the Brand(s) connected to Metricool: public user profile data and data provided in direct messages.

– Social media users who interact with the posts, messages or stories of the Brand(s) and trigger a flow configured through Flows: social network username, date and time of the interaction, flow execution history (action performed and execution status) and interactions with automated messages, including clicks on the links sent.

– Visitors to websites or blogs on which you have implemented or activated the Website Tracker: IP address, requested URL or page, referrer information, where available, and browser window and/or viewport dimensions. IP addresses are only processed in identifiable form for a maximum period of thirty-six (36) hours from their collection, after which they are deleted or irreversibly anonymised. The Website Tracker does not install, read or use cookies, localStorage or sessionStorage, nor does it assign persistent visitor identifiers.

– Persons who access Metricool through a Customer-Owned Domain: IP address.

When you use Metricool White Label or the Metricool Integration with a Customer-Owned Domain, the traffic directed to that domain will be routed through the network of Cloudflare, Inc., a content delivery network and security service provider established in the United States. This involves an international transfer of the IP address of the persons who access Metricool through that domain, based on the adequacy decision on the EU-U.S. Data Privacy Framework.

The relationship between you, as Data Controller, and METRICOOL SOFTWARE, as Data Processor, is governed by section 16.2 of the Terms and Conditions and by the Data Processing Agreement (DPA), which forms an integral part of them and of which you can request a signed copy at [email protected]. Among other matters, they regulate the subject matter and duration of the processing, the obligations of both parties, sub-processors, international data transfers, the notification of personal data breaches and the return or deletion of the data at the end of the service.

As Data Controller, you are responsible for informing data subjects about the processing of their personal data, including, where applicable, the international transfer indicated above, and for determining the legal basis applicable to such processing.
